Terms of Service

Welcome to Forward SMS. These Terms of Service ("Terms") govern your use of the Forward SMS mobile application and related services (collectively, the "Service"). By downloading, installing, or using Forward SMS, you agree to be bound by these Terms.

If you do not agree to these Terms, do not use the Service.

1. Description of Service

Forward SMS is an iOS application that enables you to automatically forward SMS text messages to various destinations, including:

• Email addresses
• Other phone numbers via SMS
• Messaging platforms (WhatsApp, Telegram, Slack, Discord, MS Teams)
• Custom API endpoints

The Service uses iOS Shortcuts automation and App Intents to intercept incoming SMS messages and forward them according to your configured rules.

2. Acceptance of Terms

By using Forward SMS, you represent that:

• You are at least 13 years old
• You have the legal capacity to enter into these Terms
• You will use the Service in compliance with all applicable laws and regulations
• All information you provide is accurate and complete

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download and install Forward SMS on your iOS device
• Use the Service for your personal, non-commercial purposes

You may not:

• Copy, modify, or distribute the app or any part of it
• Reverse engineer, decompile, or disassemble the app
• Remove, alter, or obscure any copyright or trademark notices
• Use the Service for any illegal or unauthorized purpose
• Interfere with or disrupt the Service or servers

4. User Responsibilities

4.1 Compliance with Laws

You are solely responsible for ensuring that your use of Forward SMS complies with:

• All applicable laws and regulations in your jurisdiction
• Terms of service of third-party platforms you integrate with
• Privacy laws regarding forwarding of messages
• Telecommunications regulations

4.2 Message Content

You are responsible for:

• The content of messages you forward using the Service
• Obtaining necessary consents to forward messages
• Ensuring messages do not violate others' rights or applicable laws
• Not using the Service to forward spam, malicious content, or illegal materials

4.3 Account Security

You must:

• Keep your device and app secure
• Protect your API keys, webhook URLs, and other credentials
• Notify us immediately of any unauthorized access or security breach
• Be responsible for all activities that occur through your use of the Service

5. Prohibited Uses

You may not use Forward SMS to:

• Forward messages without proper authorization or consent
• Violate any person's privacy, publicity, or data protection rights
• Send spam, unsolicited messages, or bulk messages
• Distribute viruses, malware, or other harmful code
• Harass, abuse, threaten, or intimidate any person
• Impersonate any person or entity
• Engage in any fraudulent or illegal activity
• Interfere with the proper functioning of the Service
• Circumvent any security features or access restrictions
• Use the Service for commercial purposes without our express permission

6. Third-Party Services

Forward SMS integrates with third-party services (Email providers, Telegram, Slack, Discord, MS Teams, WhatsApp, and custom APIs). You acknowledge that:

• These third-party services are governed by their own terms and privacy policies
• We are not responsible for the availability, functionality, or content of third-party services
• Your use of third-party services is at your own risk
• We do not endorse or assume responsibility for third-party services

7. Subscription and Payment

Forward SMS may offer paid subscriptions or in-app purchases:

• Free Features: Basic forwarding functionality may be available for free
• Premium Features: Advanced features may require a paid subscription
• Payment: All purchases are processed through Apple's App Store and subject to Apple's terms
• Refunds: Refund requests must be directed to Apple according to their refund policy
• Auto-Renewal: Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current period

8. Service Availability

We strive to provide reliable service, but we do not guarantee:

• Uninterrupted, error-free, or secure operation
• That all messages will be successfully forwarded
• Availability during maintenance or technical issues
• Compatibility with all devices or iOS versions

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

• THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND
• WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT
• WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
• OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICE IN THE PAST 12 MONTHS
• WE ARE NOT LIABLE FOR FAILED MESSAGE DELIVERY, DATA LOSS, OR SERVICE INTERRUPTIONS
• WE ARE NOT RESPONSIBLE FOR ACTIONS OF THIRD-PARTY SERVICES OR CONTENT FORWARDED THROUGH THE SERVICE

10. Indemnification

You agree to indemnify, defend, and hold harmless Forward SMS and its officers, directors, employees, and agents from any claims, liabilities, damages, losses, or expenses (including legal fees) arising from:

• Your use or misuse of the Service
• Your violation of these Terms
• Your violation of any rights of another party
• Your violation of any applicable laws or regulations
• Content you forward through the Service

11. Privacy

Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference. Please review our Privacy Policy to understand our data practices.

12. Intellectual Property

Forward SMS and all related content, features, and functionality are owned by us and protected by copyright, trademark, and other intellectual property laws. You may not:

• Use our trademarks, logos, or branding without permission
• Copy or reproduce any part of the app or its design
• Create derivative works based on the Service

13. Termination

13.1 By You

You may stop using the Service at any time by uninstalling the app from your device.

13.2 By Us

We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, including if:

• You violate these Terms
• You engage in fraudulent or illegal activity
• Your use poses a security or legal risk
• We discontinue the Service

13.3 Effect of Termination

Upon termination:

• Your right to use the Service immediately ceases
• You must stop using the app and may delete it
• Sections that by their nature should survive will remain in effect

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the app
• Updating the "Last Updated" date
• Providing in-app notification (for significant changes)

Your continued use of the Service after changes take effect constitutes acceptance of the new Terms.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the jurisdiction in which we operate, without regard to conflict of law principles.

16. Dispute Resolution

Any disputes arising from these Terms or the Service shall be resolved through:

• Good faith negotiation between the parties
• Binding arbitration if negotiation fails (where permitted by law)
• Individual basis only - no class actions or representative proceedings

17. Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue in full force and effect.

18. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Forward SMS regarding the Service and supersede all prior agreements.

19. No Waiver

Our failure to enforce any right or provision of these Terms will not be deemed a waiver of such right or provision.
